Terms of Service

1. Acceptance of terms

By creating an account or using SmartRuns ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

These terms constitute a binding agreement between you (or the organisation you represent) and SmartRuns.

2. Description of service

SmartRuns is a cloud-based QA test management platform that enables teams to create, organise, and execute software tests. Features include AI-assisted test generation, Jira and GitHub integrations, test reporting, and collaboration tools.

3. Account registration

• You must provide accurate and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorised use of your account at info@smartruns.io.
• One person or entity may not maintain more than one free account.

4. Billing and payment

• All paid plans are billed in advance on a monthly basis via Stripe.
• The 14-day free trial does not require a credit card. After the trial, a paid subscription is required to continue using paid features.
• Prices are displayed in USD and may change with 30 days' notice.
• Refunds are provided at our discretion. Contact info@smartruns.io within 7 days of a charge if you believe an error occurred.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period — you retain access until then.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorised access to any part of the Service or its related systems.
• Transmit any malware, viruses, or harmful code.
• Scrape, crawl, or extract data from the Service in an automated manner without our written permission.
• Resell or sublicense the Service without explicit written consent.
• Use the Service to store or process sensitive personal data (e.g. health records, financial data) unless you have a Data Processing Agreement in place with us.

6. Intellectual property

SmartRuns and its original content, features, and functionality are the exclusive property of SmartRuns and are protected by international copyright, trademark, and other intellectual property laws.

Your content (test cases, plans, comments, attachments, etc.) remains your property. By using the Service, you grant SmartRuns a limited licence to store and process your content solely to provide the Service.

7. AI features and third-party APIs

AI test generation uses the OpenAI API via your own API key. By using this feature:

• You accept OpenAI's Terms of Service and Usage Policies.
• You are responsible for any costs incurred through your OpenAI API key.
• You are responsible for reviewing and validating any AI-generated content before use.

8. Uptime and service availability

We target 99.9% uptime for the Service. Planned maintenance will be communicated at least 24 hours in advance. Enterprise plans include a formal SLA — contact us at info@smartruns.io for details.

We are not liable for downtime caused by third-party services (AWS, OpenAI, Jira, GitHub, etc.) or by circumstances outside our reasonable control.

9. Limitation of liability

To the maximum extent permitted by law, SmartRuns shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability to you for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may terminate your account at any time from the Settings page.

Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days to allow for export, after which it will be permanently deleted.

11. Governing law

These Terms shall be governed by the laws of Spain, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Madrid, Spain.

12. Changes to terms

We may update these Terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
